Index of documents (Vol.1-2) referred to in the witness statement of the Hon. Wayne Swan MP in the case of Phillip Morris Asia v. Australia. Also includes an additional volume of further material for Wayne Swan relating to the case.
The Tobacco Plain Packaging Act 2011 makes it mandatory for tobacco companies selling their products in Australia to use generic plain packaging. The legislation also requires tobacco packaging to feature large, visually-arresting health warnings which are designed to make cigarettes unappealing to smokers.
Tobacco company Philip Morris challenged this legislation (on the grounds that the legislation made it difficult for brand owners to market their products using unique design elements) but failed to have the Australian government’s plain packaging legislation overturned. Wayne Swan, then Australian Federal Treasurer, helped draft the plain-packaging laws and was called by Australia to give evidence during secret hearings in 2015.
